Estate Planning Associate Attorney
Job Overview:
We are seeking an experienced and detail-oriented Estate Planning Attorney to join our reputable law firm in, South Carolina. This attorney will provide expert legal counsel to individuals and families on a range of estate planning matters, including wills, trusts, powers of attorney, and tax strategies. The ideal candidate will have a strong background in estate planning law, experience in probate and trust administration, and a deep understanding of South Carolina laws and regulations.
Key Responsibilities:

Client Consultation & Estate Planning Development
Meet with clients to assess their needs, goals, and concerns related to estate planning. Provide clear, understandable legal advice on options available, including the preparation of wills, trusts, powers of attorney, and health care directives. -
Drafting & Reviewing Legal Documents
Prepare and customize estate planning documents, including but not limited to wills, revocable and irrevocable trusts, advance directives, powers of attorney, and business succession plans. -
Estate & Trust Administration
Guide clients through the administration of estates and trusts, including assisting executors and trustees with probate processes, asset distribution, and tax filings, in compliance with South Carolina law. -
Estate & Tax Planning Strategies
Advise clients on ways to minimize estate, gift, and generation-skipping taxes, using strategies like charitable giving, irrevocable trusts, and tax-efficient wealth transfer planning. -
Probate Court Representation
Represent clients in South Carolina probate courts as necessary, including petitioning for letters testamentary, handling estate disputes, and contesting wills or trust provisions. -
Risk Management & Asset Protection
Advise clients on asset protection strategies, including the use of trusts, LLCs, and other tools to safeguard assets from creditors, lawsuits, and other risks. -
Ongoing Client Relationships
Maintain long-term relationships with clients, providing advice and updates on changes in estate planning laws and how those changes may affect their plans. -
Legal Research & Compliance
Stay current on changes in estate planning and tax law, particularly as they apply to South Carolina, and incorporate new legal developments into client advice and strategies. -
Collaboration & Firm Development
Work collaboratively with other attorneys and staff within the firm, and contribute to firm-wide initiatives to improve client service and operational efficiency.
Qualifications:
- Juris Doctor (JD) degree from an accredited law school.
- Active and valid license to practice law in South Carolina.
- Strong knowledge of South Carolina estate planning laws, probate procedures, and tax laws.
- Excellent written and oral communication skills.
- Exceptional attention to detail and organizational abilities.
- Ability to work independently while also collaborating with a team.
- Demonstrated commitment to providing high-quality legal service to clients.
Preferred Qualifications:
- LLM in Taxation, Estate Planning, or related fields (preferred, but not required).
- Experience with business succession planning and charitable giving strategies.
- Familiarity with estate planning software and document management tools.
- Prior experience with complex estate and trust litigation (beneficial but not required).
